Australian Fitness Club Fined Under Ridiculous Carbon Tax Law


‘GFC Berwick, trading as Genesis Fitness Club, paid $6600 to the Australian Competition and Consumer Commission (ACCC) as penalty for sending a letter to its members in April promoting a “rate freeze” offer.

The fitness club said that by taking up the offer, members could avoid a fee increase of nine to 15 per cent because of the carbon price. More than 200 members took up the offer and extended their contracts.’

  1. This story has ramifications.
    Genesis may well have been correct in forewarning of price increases. They may have been correct in nominating the Carbon Tax as a future cause of increased operating costs, which in turn could be be fairly passed on to customers.
    The reason for them being fined and being unable to appeal would be that they had no basis for assessing the amount of increase attributable to the CT and they could not justify linking their “up to 15%” figure solely to the CT.
    So their “save money promotion” was unethical, even if it eventually does become an accurate prediction. I wonder if they would have recourse to appeal if circumstances prove it to have been accurate?

    Of course the Carbon Tax itself is unethical, unjust and unsupportable. It’s a pity the public has no way to punish the Australian government for false advertising and unjust taxing. Except at the next election!
